Education Law

At Gold Jennings we have expertise across the full range of education law issues.  Led by Dan Rosenberg, a solicitor with 20+ years experience, the team  is able to help parents and carers successfully navigate all aspects of the education system, and the challenges that can arise within it.   Most problems will hopefully not need recourse to a solicitor resolve.  We are here for when that expert advice is required.

Higher Education

We can advise on a range of issues which arise in the university context, including disciplinary issues, Fitness to Practice issues, allegations of discrimination, expulsions and suspensions. We can provide assistance with legal claims where appropriate, and/or complaints.

Community care

We have expertise in community care law, which is often closely linked to education, thus enabling us to offer holistic advice for families, including when seeking to secure the necessary education, health and social care provision for children with SEN or disabilities.  We have particular experience with situations where a child cannot safely remain at home.

Wider challenges

We undertake wider public law cases where appropriate, challenging decisions, policies or practices that may adversely affect many children through the process of judicial review.

Funding

We undertake work on both a privately funded and a legally aided basis.  We offer capped fees for SEN Tribunal appeals, and are normally able to offer initial advice consultations on a fixed fee basis.  Our legal aid contract enables us if appropriate to bring judicial reviews for children in circumstances where initial attempts to resolve matters have not succeeded.

For all EHCP and disability discrimination appeals, as well as all initial work in respect of any area of education law, eligibility for legal aid is based on the financial means of the parent(s) as opposed to the child.  Not all education law is within the scope of the legal aid scheme.  If you believe that you may be eligible for legal aid (e.g. you are on universal credit) please set out why in your enquiry.
